result of an accident have to be kept to a minimum. Reasonable
expenses and losses incurred will be part of the claim
against the at fault Third Party involved in the accident.

Here we give you guidance on some of the
things that can be considered by our Panel Solicitor when
negotiating on your behalf the recovery of your losses
and expenses as a result of an accident.
Any expenses you incurred as a result of
the accident, no matter how small the value, make sure
you keep a record and the receipt. If you have to use
a taxi cab or other public transport or purchase medication
etc. ask for a receipt. Keep the receipts safe until
the panel solicitor asks you for supporting evidence.
Vehicle repair
costs if you are only insured on a Third Party, Fire and
Theft policy
You can claim for the reasonable cost of
repairing your damaged vehicle against the Third Party
at fault or their insurance company. It is likely that
the Third Party’s insurance company will want to inspect
and assess the damage to your vehicle before agreeing
to the repair costs.
If you can, take photographs showing the
damage to your vehicle in case you need to refer to them
later.
If you had a comprehensive insurance motor
policy your insurers would pay for the repairs. In the
event you only have a Third Party, Fire and Theft policy
you may have to pay for the repairs yourself until it
is claimed back from the Third Party’s insurers. In circumstances
where you are unable to pay for the repairs you must obtain
a pro-forma invoice from the vehicle repairers for payment
from the Third Part’s insurers if they have accepted liability.

Replacement
vehicle hire costs
If you have a Comprehensive Motor Policy
it may include the provision of a courtesy vehicle whilst
your vehicle is being repaired. However in situations
where you are not entitled to a courtesy vehicle you may
need a Replacement Vehicle while your vehicle is off the
road for repairs.
Your options are:
General Hire Vehicle
This is when you hire a temporary Replacement
Vehicle from a local hire company. You have to pay the
hire charges up-front at the time of the hire.
Credit Hire
The vehicle Hire Company supplies a vehicle
on credit. No up-front cost to you and the Third Party
insurers pay the final invoice. We can provide you with

In both cases replacement hire vehicle charges
will form part of the claim against the Third Party who
were at fault for the accident.
As a result of a motor crash accident a
claimant is not entitled to a hire vehicle that may be
considered superior to their own damaged vehicle.
In the event your vehicle is beyond economical
repair (i.e. an insurance write-off) you will be entitled
to hire a vehicle. However, your entitlement within any
claim for a replacement hire vehicle is restricted to
a few days of ascertaining that it is a write-off and
offer for the value of the vehicle. You will not be entitled
to incur unreasonable hire charges waiting for the rest
of the claim to be settled.

Insurance
Excess if you are insured under a Fully Comprehensive
policy
Claimants often forget to claim back their
comprehensive insurance policy excess. This is the excess
amount that you have had to pay to the garage when your
vehicle damage was repaired.

Damaged
vehicle towing and storage charges
The reasonable cost of towing/uplifting
a damaged vehicle to a storage compound and a garage for
repairs while the claim is being processed.

Diminution in value
In some cases this uninsured loss can be
claimed against the third party who was at fault. Diminution
in value is where a damaged vehicle has been repaired
but because it was damaged in an accident the value of
the vehicle has been reduced. There must be evidence to
show that the vehicle value repaired is less than if it
had not been damaged in the accident.

Personal
Injury
