Accident Injury Victims of Uninsured and Untraced Drivers

There are a growing number of people in the UK driving without insurance, MOT and some even without a valid driving licence. Many of these drivers are driving stolen cars. What happens if you are involved in an accident with one of them.

If you have been unfortunate to be involved in an accident with a hit and run driver or an uninsured or untraced driver, you may still be entitled to compensation for any personal injury you sustained and uninsured losses.

These types of cases are claimed through the MIB. The Motor Insurers Bureau (MIB) is an organisation that deals with claims for victims of uninsured and untraced drivers who have caused personal injury or damage to property. The MIB is a fund to which all vehicle insurers are required to contribute to support victims of such Accidents in the UK and Accidents Abroad.

You may have been driving your vehicle, motorcycle, pedal cycle or be a pedestrian. If the other vehicle was deliberately aimed at you to cause damage or harm to you then this is more likely to be deemed as a crime of violence.

  • The police must have been informed of the accident. This is one of the requirements of making a claim for compensation. Keep a note of the police station, the police report reference number and location of accident.
  • A claim for personal injury must be made within 3 years of the accident.
  • A person travelling in an uninsured vehicle who new or reasonably should have known it was uninsured are excluded from claiming compensation.
  • The owner of an uninsured vehicle, which at the time of the accident was not insured as required by the Road Traffic Act are unable to claim from the MIB in respect of damage to that vehicle.

It is important that an MIB specialist solicitor deals with your case to achieve the maximum compensation level you deserve. We provide professional legal assistance dealing with the lengthy and complex procedures of the claim. The correct approach to the claim with legal assistance helps to speed up the claim.

Claiming compensation involving untraced or uninsured motorist is more complex than if the driver was insured and requires investigation. Our specialist panel solicitor has the expertise and experience to deal with untraced and uninsured driver claims through the MIB on your behalf.
